How far the right to be forgotten should be protected in cyberspace is still unclear and controversial. In the opinion of the AG Szpunar delivered on the case Google CNIL on 10 January 2019 (case C-507/17) a search engine operator is not required to implement a request for de-referencing of personal information on all extensions of its domain name and search requests made outside the territory of the Union should not be subject to de-referencing. Limiting the territorial scope of this right solves several practical, political and legal issues arising from the need to strike a fair balance between conflicting human rights. Yet, the proposed solution is not consistent with the tendency to impose measures with extraterritorial scope in order to provide individuals with effective and complete protection.
